I did a little bit more research on Swingin' Summer. The film includes music by A-list rock bands like Gary Lewis and the Playboys, so I guess I'll have to check to see if some of those songs could be copyrighted separately.

Sounds like a film that, if it were truly in the public domain, it'd certainly be available already from Mill Creek, Alpha, and a hundred other PD DVD companies.

I looked into that. It hasn't been released on DVD by anybody. Just two old VHS releases that you can buy on ebay or amazon. There are a lot of PD films that haven't been released by Mill Creek et al because they can't get their hands on a good print to digitize although given the quality of some of their stuff you would think they are using digitized VHS movies.

Re: Film music, a lot of times films just got buyout rights for the music so even when the film goes PD the music rights are still intact. I don't think it is possible to tell without seeing the contract. I've seen PD movies like "Curse of Demon Mountain" that includes The Band's, "The Night they drove Old Dixie Down" in the Soundtrack.

Maybe VideoCellar will have more to say about this.
